Terms and conditions

These Terms and Conditions will form part of the sales contract.

1. INTRODUCTION

  1. These are the ‘Terms and Conditions’ on which Faith Mother (referred to in these terms as ‘we’ and ‘us’) will conduct business and supply products to you.
  2. You can contact us by emailing hello@faithmother.com or by calling +44 (0) 1625 461199. If we need to contact you, we will do so by using the details provided by you when placing your order.
  3. Our registered address is 99 Moss Lane, Alderley Edge, Cheshire, SK9 7HP.
  4. When we use the words ‘writing’ or ‘write’ in these terms, this also includes email.
  5. A ‘Bespoke Product’ refers to items that are customised, made to measure, or personalised to your requirements such as by engraving or selecting a certain gemstone.
  6. Goods (or any part of them) are set out in the Order in accordance to the terms and conditions.

2. OUR CONTRACT WITH YOU

  1. These terms and conditions are published on our website faithmother.com
  2. Your Order is considered to be an offer by you to purchase Goods according to these terms and conditions. You will be responsible for ensuring that the terms of the Order are complete and accurate.
  3. Orders for Goods can be made by you online through our website (online order).
  4. The contract of sale will be formed when payment has been received in full and you have received an email from us with details of your order, at which point the contract will come into existence between you and us and it will be deemed that you have accepted these terms and conditions.
  5. The consumer right to cancel a contract under the Consumer Contracts Regulations 2013 do not apply to Bespoke Products. If for any reason you wish to cancel an order for a Bespoke Product you should contact us immediately.

3. GOODS

  1. The goods are described on our website. Whilst every effort is made to provide an accurate description and image on our website or any printed material, these are illustrative only and it may be that the scale and colours shown are different in real life. Such variations do not constitute faults in the final product.
  2. We do not warrant or undertake that Goods displayed on the website will be available for purchase by you.
  3. You warrant that the Goods are for personal, and not commercial use.

4. OUR RIGHTS TO END THE CONTRACT

  1. If we are unable to accept your order, for any reason, we will inform you of this immediately
  2. If once the contract comes into existence, we are unable to contact you despite our reasonable efforts for a period of 15 working days, we may end the contract and paragraph 4.3 will apply.
  3. If we end the contract in the situations set out in paragraph 4.2 you may still be charged the full product price. In addition, we may charge you reasonable compensation for the net costs we will incur as a result of you breaking the contract.

5. RISK AND TITLE

  1. Once payment for the Goods has been received in full along with any associated delivery costs, and the Goods have been dispatched to you, transfer of ownership will occur and you will own the Goods.

6. COMPLETION DATES

  1. Where you have placed an Order, an estimated completion date will be given and will usually be approximately eight weeks from the date on which the order has been acknowledged.
  2. Whilst we will do our absolute best to accommodate completion dates, it is important to understand that our jewellery is never compromised or rushed and as such the completion date is an estimation only.

7. DELIVERY

  1. We will only deliver and therefore only accept Orders from the list of countries as specified on our Delivery policy on our website.
  2. You acknowledge that we use a third party courier or other tracked mailing service for the delivery of Goods.
  3. Goods will be delivered to you as soon as reasonably possible and within 30 business days from the dispatch date. If you do not receive the Goods within this time frame you must notify us immediately.
  4. Delivery dates quoted are an estimate only.
  5. For customers outside of the UK, orders are subject to the relevant duties and taxes at time of delivery, which are the responsibility of the customer and must be paid by you to the relevant authority. Duties and taxes are non-refundable.
  6. Goods will be delivered to the address provided to us when placing your order or to another such location if this has been agreed in writing. It is your responsibility to ensure address details are correct and that we have adequate delivery instructions or any other instructions that are relevant to the supply of the Goods.

8. PRICE AND PAYMENT

  1. The price of the product (which includes VAT) will be as set out on our website (for online orders) as at the date of the order.
  2. It is possible that despite our best efforts, some of the Goods may be incorrectly priced. Prices are usually checked when accepting an order. Where the correct price of the Goods is less than the price stated in the order at your order date, we will charge the lower amount. If the correct price of the Goods is more than the price stated in the order at your order date, we will contact you to discuss and for your instructions before accepting your order. If we accept and process your Order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the Terms & Conditions, refund you any sums you have paid and require the return of any Goods provided to you.
  3. We accept payment for Orders by debit or credit card only.
  4. We may, by giving notice to you at any time up to ten (10) Business Days before delivery, increase the price of the Goods to reflect any increase in the cost of the Goods that is due to any factor beyond our control (including foreign exchange fluctuations, increases in taxes and duties, and increases in materials costs) or any delay caused by any of your instructions or your failure to give us adequate or accurate information or delivery instructions.

9. CANCELLATIONS, RETURNS AND REFUNDS

  1. This clause does not apply to Bespoke Goods which the parties agree cannot be returned or refunded and paragraph 9.4 regarding cancellation of online orders will not apply.
  2. Bespoke Goods will be made or customised especially for you; because of this, no refunds will be given on any bespoke or customised piece of jewellery under any circumstances, unless the finished product is deemed to be mis-described, faulty or defective.
  3. Where an item is eligible for return, it must be received within 14 days of receipt of delivery. Items must be without wear and in original packaging as delivered. Please see our Returns Policy on our website for more details.
  4. Should you cancel an Online Order before it is dispatched, where eligible, you will receive a full refund for the Goods. Should you cancel an Online Order after it has been dispatched and within fourteen (14) days of delivery of the Goods, then, where eligible, you may either request a full refund or exchange the Goods. If the Goods have been delivered to you, you must either return them to us at your own expense using an agreed courier.
  5. Where eligible to return, we will not accept Goods that have been worn or damaged. When returning Goods, you shall be responsible for ensuring that the Goods arrive in perfect condition, properly packaged and safely returned to us. We shall proceed to any applicable refund after we have received the returned Goods and provided that the state of the returned Goods is to our satisfaction.

10. MARKETING AND INTELLECTUAL PROPERTY

  1. All intellectual property rights in the design of your piece, in any of the drawings or images produced or the finished product shall be owned by us.
  2. We have full right to use photos and/or videos of the product(s) on our website, social media profiles, and any other marketing material for the purposes of promoting our business.
  3. It is your responsibility to ensure that you have all necessary ownership rights or usage rights in any materials provided to us.
  4. This section (10) shall survive termination of the terms and conditions.

11. YOUR PERSONAL INFORMATION

  1. We will use the personal information you provide to us to supply the products and associated paperwork to you and to give you information about similar products and company news, typically via an emailed newsletter, but you may stop receiving this at any time by contacting us. Please see our Privacy Policy for more information.

12. AFTERCARE

  1. As part of our aftercare service, Faith Mother will repair all pieces of jewellery within one year of purchase at no additional cost to the customer if there is clearly a fault in the manufacturing.
  2. If the damage is as a result of heavy wear or is beyond the one year warranty period will be happy to repair your Faith Mother jewellery for a small charge.

13. FORCE MAJEURE

  1. We shall not be under any liability of any kind for non-performance in whole or in part of our obligations under the contract due to causes beyond the reasonable control of the Company or of the Company’s suppliers.

14. FURTHER INFORMATION

  1. By proceeding with the Order, you confirm that you accept the terms and conditions and that you agree to comply with them. If you do not agree to these terms, you must not proceed with the Order. We recommend that you keep a copy for future reference.
  2. Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
